Judge puts injunction on Bill 26

The Court of King’s Bench of Alberta has granted an injunction preventing the Government of Alberta from creating legislation that bans gender-affirming care for minors.

The request came from Egale Canada and Skipping Stone, two not-for-profits that support 2SLGBTQ+ and trans people as well as five gender-diverse young Albertans and their parents.

After a two-day hearing in Calgary in March, the judge reviewed the arguments on both sides and released the decision on Friday afternoon. Bennett Jensen, director of legal at Egale, says they began the constitutional challenge and injunction over the medication sections of Bill 26, which includes puberty blockers and hormone replacement therapy. They wanted to get it into court as soon as possible over fears of potential results if Bill 26 were to pass.

While there is a constitutional challenge on the surgery portion of the bill, Bennett said there wasn’t an injunction put on it as minors under the age of 18 are unable to receive genital surgery, and chest surgeries are only done in extremely rare cases.

Alberta opposition leader Naheed Nenshi said in a news release that the ruling came as good news to the NDP.

“We are pleased to hear the news of the Court of King’s Bench of Alberta has ruled to block Danielle Smith and her UCP government’s attempts to restrict the freedoms of parents, medical professionals and children under Bill 26 by banning certain forms of care.”

In the ruling, Justice Allison Kuntz noted that a ban on gender-affirming care could cause irreparable harm to gender-diverse young Albertans. She also noted that Bill 26 also goes against Sections 7 and 15 of the Charter of Rights and Freedoms.

The injunction on Bill 26 means gender-diverse youth will continue to be able to receive gender-affirming care with consultation with their caregivers and doctors.
