Defence in manslaughter case waiting for disclosure

The lawyer for a 45-year-old man charged with manslaughter, is getting frustrated with the amount of time it’s taking to receive disclosure.
Lethbridge lawyer Tracy Hembroff said Tuesday during a brief hearing in Lethbridge provincial court that her client, Sheldon Nicholas LePage, has been in custody for nearly two months, and while the news media has already published information about the autopsy and cause of death, she is still waiting to receive information about the case.
“We have nothing, zero, so I would really like to get some disclosure on this file,” Hembroff said.
Crown Prosecutor Adam Zelmer reviewed his computer file and pointed out his information about disclosure does not reflect what Hembroff told the court, and he suggested he and the defence discuss the matter during a break in court proceedings. Following the brief discussion with the Crown, Hembroff said they will investigate the issue further to determine where the problem lies, and the matter was adjourned to July 14.
The manslaughter charge stems from an incident at about 8:30 p.m. on May 5 of this year when the victim was approached by a man near the intersection of 8 Street and 2 Avenue North.
During an argument, the man struck 44-year-old Amber Bahadur Khadka , knocking him down and causing him to strike his head on the ground. The assailant left the area, but was found by police and arrested later in the day.
Police said the two men knew each other and the altercation was targeted at the victim. An autopsy May 9 confirmed the cause of death was homicide.
