Bail denied man facing criminal charges

A Coaldale man who is accused of several criminal offences and believes the charges against him are fake, has been denied bail.
Cody Gregory Fleming had hoped to be released from remand custody Wednesday, but following his bail hearing in Lethbridge provincial court, he was detained on charges of assault and failing to comply with release conditions. In addition, bail he was granted earlier this year on charges of assault, failure to comply with release conditions, assault with a weapon, possession of a weapon dangerous to the public peace and threats to cause death or bodily harm, was revoked.
Information and evidence presented during the bail hearing, as well as reasons for the judge’s decision, are subject to a publication ban.
Fleming, who is remanded at the Lethbridge Correctional Centre and attended court by CCTV on Tuesday, as well, told the judge he believes the charges against him are fake and that his arrest was unlawful.
“I never got read my Miranda rights on any charge,” Fleming said Tuesday.
Fleming, 37, was arrested June 19 on the charges of assault and failing to comply with release conditions, and duty counsel was prepared to help Fleming conduct a bail hearing Tuesday, but the judge adjourned the matter for one day to allow counsel time to receive disclosure from the Crown and prepare for the hearing.
During his court appearance Tuesday, Fleming constantly interrupted the Crown prosecutor, swore, and demanded to know who he was accused of assaulting.
“Bull s–t,” he told Crown prosecutor Sheena Campbell as she read the charges. “No, no, that’s ridiculous.”
Campbell said the accused was in court last month, as well, and she understood he was going to apply for counsel, but she hasn’t heard from any lawyers and no one appeared for him in court.
Fleming said, however, he doesn’t need to apply for Legal Aid.
“I’ve never been read my Miranda rights, they’re all illegal charges,” Fleming said. “I’ve never been charged, these are all bulls–t charges. There’s no reason I should have to answer to these. It’s a stupid little game that everybody’s playing.”
The judge advised Fleming to get legal counsel, and adjourned the matter for a day. When the case returned Wednesday, the bail hearing proceeded with duty counsel and he was detained.
The matter is scheduled to return to court next Wednesday to see if Fleming was able to retain a lawyer.
