Man sentenced after pleading guilty to multiple offences

In Lethbridge provincial court on Wednesday, 26-year-old Nicholas Bartosek-Whimster was sentenced to a total of 75 days in custody after pleading guilty to an indecent act in public in the presence of one or more persons, failure to comply with release order conditions, theft under $5000, two counts of mischief causing damage under $5000 and breach of probation.
On July 11 Bartosek-Whimster exposed himself several times in front of a large group of children at a city skate park while intoxicated, for which he received 30 consecutive days in custody. On July 17 the accused failed to comply with his release order to not be intoxicated in public while at north side Dairy Queen. For which he received five days concurrent in custody. On Aug. 25, 2021, Bartosek-Whimster was invited to an acquaintance’s house and while there, he stole a bicycle and a hat from the individual, for which he received 15 consecutive days in custody. On June 5, 2020, the accused broke a sign belonging to the Ramada Inn, for which he received 15 consecutive days in custody.
On Aug. 20, 2020, while a car was driving on 13 Street North, Bartosek-Whimster threw a glass bottle and broke the windshield. A CCTV video from a nearby business confirmed the identity of the accused. He received 15 consecutive days in custody.
Bartosek-Whimster also failed to report to his probation officer on another date and received one day concurrent in custody as well as 12 months of probation.
At of the time of sentencing he had served 50 consecutive days in custody, for which he received a credit for 75 days, and therefore his sentenced was served and he was released from custody.
One count of failure to comply with a summons and two counts of trespass on premises were withdrawn.
