Court hands down 90-day sentence for housebreaking

A 32-year-old southern Alberta man who broke down a door to get into a northside residence has been sent to jail for 90 days.
Ellery Dillon Standing Alone pleaded guilty Tuesday in Lethbridge provincial court to one count of housebreaking and commit mischief. And although he was sentenced to three months behind bars, he will be allowed to serve his sentence on weekends, beginning this Friday.
Court was told that for much of the evening on Nov. 13, 2021, Standing Alone and a woman had been drinking in her home on St. James Boulevard North. At one point Standing Alone became unruly and the woman told him to leave.
“Mr. Standing Alone was behaving in a way that was causing (the woman) some discomfort,” the Crown prosecutor explained.
Standing Alone, who was heavily intoxicated, left the residence, but returned and broke down her balcony door. He began yelling at her and demanded she return his keys.
“However, he had his keys with him,” the Crown pointed out.
The Crown and Lethbridge lawyer Claudia Connolly recommended Standing Alone receive an intermittent jail sentence, which would allow him to care for his nine-year-old daughter and continue working in a manufacturing plant during the week.
In addition to the 90-day sentence, Standing Alone will be on probation for six months, during which he must behave and attend court when required. He must submit a sample of his DNA for the National DNA Databank, and he must be sober when he attends the Lethbridge Correctional Centre at 6 p.m. each Friday.
Additional charges of theft under $5,000 and mischief causing damage under $5,000 were withdrawn.
